Republicans Float Booting Biden Off State Ballots After Trump Ruling

In unprecedented move after unprecedented move, following the all-Democratic Colorado State Supreme Court ruling that former President Donald Trump’s name cannot appear on the 2024 primary ballot, Texas is considering banning President Joe Biden.

Lt. Gov. Dan Patrick (R) floated the idea of preventing Biden’s name from appearing on the 2024 Texas ballot due to allowing eight million people to cross illegally into the country since taking office in 2021.

On Tuesday, the Colorado court ruled that Trump’s comments leading up to the Jan. 6, 2021, protest and breach of the Capitol in Washington, D.C., “constituted overt, voluntary, and direct participation in the insurrection.”

In a peculiar interpretation of a clause in the 14th Amendment, the Colorado court ruled that Trump’s comments and actions disqualified him from serving in federal office.

Many have pushed back against the ruling, pointing out the 14th Amendment was designed to address Civil War-era issues and that Trump was never convicted of insurrection or attempting to overthrow the U.S. government.

Patrick told Fox News host Laura Ingram: “Seeing what happened in Colorado makes me think — except we believe in democracy in Texas — maybe we should take Joe Biden off the ballot in Texas for allowing 8 million people to cross the border since he’s been president, disrupting our state far more than anything anyone else has done in recent history.”

Florida Gov. Ron DeSantis noted that the Colorado ruling was vague and could easily be abused, prompting an endless cycle of political tit-for-tat actions. Musing the possibilities while speaking at a campaign rally in Iowa, the presidential candidate said: “Could we just say that Biden can’t be on the ballot because he let in 8 million illegals into the country, and violated the Constitution?”

DeSantis added he believed the ruling would be reversed by the U.S. Supreme Court, and that DNC efforts to hurt Trump politically will serve to benefit him in the long term.

“I think the US Supreme Court is going to reverse that,” he said. “They’re doing all this stuff to basically solidify support in the primary for him, get him into the general. And the whole general election is going to be all this legal stuff.”

Trump decried the ruling and echoed previous statements accusing President Biden of weaponizing the Department of Justice: “Joe Biden is a threat to democracy,” Trump said on Tuesday evening at a campaign rally in Iowa. “[The Democrats] are weaponizing law enforcement for high-level election interference because we are beating them so badly in the polls,” he added.

Former Trump attorney Jenna Ellis also criticized the Colorado court ruling. In a post on X, she noted the ruling was “nonsense” and that Republicans should illustrate the danger of such a ruling by turning the tables and initiating action against Biden: “What is absolutely wild about this opinion from the Colorado Supreme Court is that it contains no limiting principle,” Ellis wrote.

“Republicans should immediately file suit in Colorado to remove Biden from the ballot, citing his failure to secure the border and allowing an invasion falls within the Court’s broad definition of ‘engaging in insurrection,’” she added. “Challenge this nonsense.”

Public health policy analyst Pradeep Shanker agreed with Ellis and added: “One could argue that since Biden made a deal with Iran to free up their billions of dollars in funds, that he gave aid and comfort to the enemy … and if you have no legal standard, then you have to accept any judge that says that. Right?”

“And Democrats would have to accept that if a judge finds that, well … then too bad for Biden, he is ineligible. Right?” Shanker added. “Because apparently there is no legal standard.”

Conservative social media influencer Rogan O’Handley also agreed and added: “If Colorado is taking Trump off the ballot, Florida and Texas should take Biden off the ballot. Allowing 8M+ illegal aliens into America is the greatest form of insurrection[.] See how slippery this slope gets?”

Conservative commentator Gunther Eagleman also agreed and said: “Every Republican state AG should be filing to remove Joe Biden from the ballot this morning … The insurrection and blood at the Southern border is on him.”

Commenting on the Colorado court ruling, Trump campaign spokesperson Steven Cheung said: “Unsurprisingly, the all-Democrat-appointed Colorado Supreme Court has ruled against President Trump, supporting a Soros-funded, left-wing group’s scheme to interfere in an election on behalf of Crooked Joe Biden.”

Cheung added: “Democrat Party leaders are in a state of paranoia over the growing, dominant lead President Trump has amassed in the polls. They have lost faith in the failed Biden presidency and are now doing everything they can to stop the American voters from throwing them out of office next November.”

Colorado’s primary is scheduled for March 5. Trump has until January 4 to appeal the court’s ruling.
